Diesel Emissions Claims

The ‘dieselgate’ scandal broke in 2015 when it emerged that a number of brands had used a ‘defeat device’ to disguise how much emissions were being released from their vehicles. The 'defeat devices' caused diesel engines to activate emissions controls only during laboratory emissions testing, which caused the vehicles' output to meet regulatory standards during testing. In some cases, the noxious emissions were 35 times their legal limit, causing a lot of pollution.

Whilst the car brands are reluctant to give discounts or admit any wrongdoing, you have the opportunity to make a claim for diesel emissions and receive a large lump sum as compensation. Currently, this is said to have impacted 500,000 vehicles in the UK where the owners could be eligible for compensation. 

In September 2019, Daimler (Mercedes Owner) was fined 870 million euros in Germany for "negligent violation of supervisory duties" in relation to not fully complying with emissions regulations.

An average £8,500 in compensation is estimated for each claimant in the case, with the action possibly totalling up to £10.2 billion across the nation. This would make it one of the biggest group actions ever seen in the UK. Can I claim compensation for my diesel car?

What does it cost to make an emissions claim?

You only pay a fee to the legal firm handling your case if your claim is successful. This is expected to be in the range from 20-40 percent, but you will be told what the fee is when your claim is approved. The fee is capped at 50%, so you will definitely get at least half of the compensations. If the claim is not successful, ‘after the event’ insurance (known as ATE) is provided by the law firm. This will cover any legal fees that you are liable for.

Yes. Cars bought on finance, including second-hand cars, are still eligible.

Can I make an emissions claim for multiple cars?

Yes. You can make a claim for each vehicle you bought which is eligible. Just fill out a separate form for each car.

How long does an emissions claim take?

This is part of a group action lawsuit which is a complicated legal proceeding. This means it is difficult to estimate a timeframe, but it will likely take a few years. In the case of VW claims, they were first grouped together by the court in May 2018, with the trial due in January 2023. However, a settlement was reached in May 2022.

Which manufacturers can I make a diesel emissions claim against?

At the moment you can only claim against Mercedes in the UK. However, many vehicles were also affected by the initial scandal including Volkswagen, BMW, Vauxhall, Ford, Citroen, Peugeot, Renault, Nissan, Skoda, Jaguar, Volvo, Hyundai, and Land Rover.
